We appreciate your interest in our products and thank you for visiting our website. These Terms & Conditions explain the rules that apply when you browse our website, create an account or purchase products from us.

By using our website or placing an order, you agree to these Terms.

 

 

1. About Us

This website is owned and operated by MIJ AUS Pty Ltd ("MIJ", "we", "our" or "us").

Our website is intended for customers located in Australia and other countries to which we choose to supply products.

 

 

2. Using Our Website

You may use our website for personal or legitimate business purposes.

When using our website you agree that you will not:

  • use the website for any unlawful purpose;

  • interfere with the operation or security of the website;

  • introduce malicious software or viruses;

  • attempt to gain unauthorised access to our systems;

  • create false customer accounts;

  • impersonate another person or business;

  • use automated software to access our website except where we have provided written permission.

We reserve the right to suspend or block access where we reasonably believe these Terms have been breached.

 

 

3. Products

We work hard to accurately describe and photograph every product we sell.

Because many of our products are handmade by skilled artisans in Japan, natural variations in colour, glaze, texture, dimensions and finish are part of their character and are not considered defects.

Colours displayed on your screen may also vary depending on your device.

Product specifications, availability and pricing may change without notice.

 

 

4. Orders

Placing an order does not automatically mean your order has been accepted.

We may decline or cancel an order where:

  • payment cannot be authorised;

  • products become unavailable;

  • pricing or product information contains an obvious error;

  • we reasonably suspect fraudulent activity;

  • the order appears inconsistent with these Terms.

If payment has already been made for a cancelled order, we will provide a full refund.

 

 

5. Pricing & Payment

Unless stated otherwise, all prices are shown in Australian Dollars (AUD) and include GST where applicable.

Shipping charges are calculated separately during checkout.

We reserve the right to change prices at any time before an order is accepted.

If an obvious pricing error occurs, we may cancel the order and provide a refund.

 

 

6. Shipping & Returns

Information about delivery times, shipping charges and returns can be found in our Shipping Policy and Returns Policy.

Nothing in these Terms limits your rights under the Australian Consumer Law.

Where our products fail to meet a consumer guarantee under Australian Consumer Law, you are entitled to the remedies provided by law.

 

 

7. Intellectual Property

Everything you see on this website has value.

Unless otherwise stated, all content on this website is owned by or licensed to MIJ, including:

  • product photography;

  • lifestyle photography;

  • product descriptions;

  • specifications;

  • graphics;

  • logos;

  • videos;

  • buying guides;

  • blog articles;

  • downloadable resources;

  • website design;

  • collection pages;

  • product organisation and presentation.

This content is protected by Australian and international intellectual property laws.

You may browse and use our website for personal shopping purposes.

You may not copy, reproduce, publish, distribute, modify or commercially use any content without our prior written permission.




 

 

8. Wholesale Customers

We value our wholesale partners and aim to build long-term relationships based on mutual trust and respect for the MIJ brand.

To protect our customers, suppliers and brand, approved wholesale customers agree that they will not, without our prior written approval:

  • sell MIJ products through online marketplaces such as Amazon, eBay, Etsy, Temu, Catch, MyDeal, Kogan Marketplace, Facebook Marketplace or similar platforms;

  • participate in or supply products to dropshipping businesses or supplier networks;

  • upload or distribute our catalogue, product data or images to third-party marketplaces or dropshipping platforms;

  • provide our product data, images or descriptions to another business for resale;

  • represent themselves as MIJ, Made in Japan or an authorised distributor unless expressly authorised by us;

  • use our trademarks in a manner that suggests an official relationship beyond the scope of their approved wholesale account.

Approval may be granted in writing for specific sales channels where they align with our brand and customer experience.

We reserve the right to suspend or terminate any wholesale account that breaches these Terms.

 

 

8A. Brand Protection & Content Licence


As an approved Wholesale Customer, we grant you a limited, non-exclusive, non-transferable and revocable licence to use MIJ product photographs, product descriptions and other approved marketing content solely for the purpose of promoting and selling genuine MIJ products purchased directly from us.

This licence:

  • applies only while you remain an approved Wholesale Customer in good standing;

  • does not transfer ownership of any intellectual property to you;

  • does not permit you to modify our content in a way that misrepresents our products or brand;

  • does not permit you to provide or sublicense our content to any third party without our prior written consent.

This licence automatically ends if your wholesale account is suspended or terminated, or if you cease purchasing products directly from MIJ.

Upon termination of the licence, you must promptly stop using MIJ content and remove it from your website, online stores, marketplaces, catalogues, advertising and other marketing materials in accordance with Section 8B.

 

 

8B. Compliance & Enforcement

If we reasonably believe that a Wholesale Customer has breached these Terms, we may take any action we consider reasonably necessary to protect our business, customers and intellectual property.

This may include:

requesting the removal of unauthorised content, listings or advertisements;

requiring the removal of MIJ images, descriptions or other content from websites, marketplaces or other sales channels within 7 days of our written request;

suspending or terminating wholesale pricing or account access;

refusing future orders;

taking further legal action where necessary to protect our intellectual property or brand.

Where appropriate, we will endeavour to work with our Wholesale Customers to resolve issues before taking enforcement action. However, we reserve the right to act immediately where we reasonably believe our intellectual property, reputation or customers may be adversely affected.

 

 

9. Website Content & Automated Access

We invest significant time and resources creating original product photography, descriptions and educational content.

You must not use automated software, bots, crawlers, scrapers, spiders or similar technology to:

  • download our catalogue;

  • copy product information;

  • harvest pricing;

  • reproduce images;

  • create competing databases;

  • monitor inventory for commercial purposes;

  • interfere with the normal operation of the website.

Reasonable search engine indexing by recognised search engines is permitted.

 

 

10. Artificial Intelligence

Our content may not be used to train artificial intelligence systems, create datasets or generate derivative commercial databases without our prior written permission.

This includes product descriptions, photography, specifications, buying guides and other original content published on our website.

 

 

11. Privacy

Your privacy is important to us.

Our collection and use of personal information is explained in our Privacy Policy.

By using our website you consent to the handling of your information in accordance with that policy.

 

 

12. Liability

We aim to provide accurate information and reliable service, but we cannot guarantee that our website will always operate without interruption or error.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from the use of this website or our products.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or any other law that cannot legally be excluded.

We may update these Terms from time to time.

The latest version will always be available on our website.

Continued use of the website after changes have been published constitutes acceptance of the updated Terms.

 

 

14. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising from these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
